Civil Servant Dock For Alleged Tape Recorder, Memory Card Theft
A civil servant working with the Rivers State Ministry of Budget and Economic Planning, Tonye Okunba has been docked by a state Chief Magistrate Court for allegedly stoling a voice recorder and a 16GB memory card belonging to one Ariye Godwin.
Okunba is standing trial on a two-count charge bordering on alleged stealing and breach of public peace before Chief Magistrate Emmanuel Beauty Okere.
The first count charge read to the accused states, “That you, on the 11th day of February, 2021, at Lacent Dental Hospital, Rumuola, in Port Harcourt Magisterial District, did conduct yourself in a manner likely to cause a breach of peace by unlawfully seizing a voice recorder used for a meeting, and ran away with same property, thereby committed an offence punishable under Section 249 (d) of the Criminal Code Cap 37, Vol. 11 Laws of Rivers State, 1999.”
Count two reads, “That you, Tonye Okunba, stole one 16GB memory card valued at N100,000.00, containing several sensitive and valuable information, property of one Ariye Godwin, thereby committed an offence punishable under Section 390 (2)of the Criminal Code Cap 37, Vol. 11 Laws of Rivers State, 1999.”
However, when the two-count charge was read to the accused person, he pleaded not guilty of all the charges brought against him.
Counsel representing the accused, Ukpe F.A., while moving an oral application for bail consideration, urged the court to grant his client bail on liberal terms, adding that the offence allegedly committed was bailable.
He appealed to the court to exercise its discretion in accordance with Section 36 of the 1999 Constitution as amended, adding that his client has a reputable surety, and would not jump bail, if admitted.
In her ruling, the presiding Chief Magistrate, Emmanuel Beauty Okere, after listening to the bail application from the accused lawyer, admitted the accused to bail for N100,000.00 in like sum, with a surety, whose passport photograph must be domiciled with the court.
The chief magistrate also said that the surety must reside within the jurisdiction of the court, and adjourned the matter to January 21, 2022 for continuation.
