Sealing Of Palace:Lawyer Threatens To Sue NJC
A Lagos-based legal practitioner, Muyiwa Yinka, has threatened to petition the National Judicial Council of Nigeria (NJC) over the alleged sealing of Henshaw Town Traditional Rulers Council in Calabar South Local Government Area (LGA) of Cross River State.
Yinka stated that the secretariat of the traditional rulers’ council has remained sealed since June, 2019 by people he described as “thugs”.
In a protracted argument between counsel to plaintiff, Yinka Muyiwa vs defendant’s counsel Williams Awan, at High court 6, Mary Slessor Road Calabar, Yinka told the court that he was properly brought in to take over this matter from the former, counsel, E.E. Osim and not through the back door as alleged by counsel to defendant.
Awan had during the heated argument, alleged that Yinka came into the matter through the back door.
In a swift reaction to the allegations, documents were tendered to the court by Muyiwa to back up his claim that the allegations by defendant’s claims were not factual.
However, the presiding Judge, Hon. Justice Francesca Nnang Isoni, asked the parties involved in the argument to go for break and returned in two hours for judgment.
In Suit No H/C/186/2019, the plaintiff, HRH, (Etubom) Inyang Henshaw, clan head for Effanga Offiong Edet Nsa of Calabar South LGA, with his chiefs in council had gone to court praying the court to, “Grant leave to the claimants to change their council from E.E. Osim to Yinka Muyiwa” over the issue of the sealed palace.
Earlier at the premises of the Mary Slessor Road, in a question and answer session with newsmen, Yinka said; “I represent the claimants to take off the injustice.
“No one has the power to lock up any place, not even a residential house against a tenant by a land lord. It is illegal.
“I advised that the matter be brought up urgently to prevent crisis.
My chamber had approached the court as a matter of urgent attention and the Chief Judge of this state approved that the matter be heard during the vacation.
“We got hint that a retired justice from the community (name with held) is trying to frustrate the matter and buy time in favour of the defendants”.
