Federal High Court Reserves Judgment On Citizenship Right Suit
A Federal High Court sitting in Port Harcourt has fixed 24th of November, 2022 to deliver judgment in a suit filed by the Peoples Democratic Party (PDP) against the Governorship Candidate of the All Progressives Congress (APC) in the state, Patrick Tonye-Cole, and Independant National Electoral Commission (INEC).
Justice Emmanuel Obile of the Federal High Court 2, Port Harcourt reserved the Judgment for November 24, 2022 after listening from the counsels representing the parties in the suit.
The PDP in the suit is challenging the eligibility of Arch. Tonye Cole, the gubernatorial candidate of the APC, on grounds of his dual citizenship of Nigeria and the United Kingdom.
Recall that the same judge, Justice Obile Emmanuel, had on October 25, 2022 given a judgment that disqualifed Tonye Cole and all candidates of the APC for the 2023 general elections in the suit brought by George Orlu & Ors v. All Progressives Congress.
However, a panel of the Court of Appeal sitting in Port Harcourt stopped the INEC from giving effect to that judgment last Friday and ordered the three sets of Applicants to file their Appellants briefs, having granted them leave to appeal against the judgment.
Counsel to Tonye Cole, Chimenem Jerome, spoke to journalists on details of what transpired in court with the expectation that justice would be done in the matter.
