Rivers Court Set To Hear N50bn Suit Against Shell, Two Others
The Rivers State High Court has fixed February 7 and 8 for the hearing of preliminary objections in the N50billion suit against Shell Petroleum Development Company (SPDC) of Nigeria Limited filed by a couple, Emeka and Stella Okoli.
The couple, who worked with the company, sought payment of N50billion as damages for the alleged medical negligence that led to the damage of their son’s brain.
In suit number PHC/2338/2021 filed before Justice Weli Chechey of the Rivers State High Court, the couple accused two doctors of Shell Hospital, Dr Alexander Dimoko, and Dr Dafe Akpoduado, of negligence while performing an appendectomy surgery on their son, Chinazam, sometime in September, 2016.
The defendants in the suit are Shell, Dimoko and Akpoduado.
The couple, in a 55-paragraph statement of claims, alleged that the doctors operated on their son without making scientific enquiries, adding that the procedure the doctors claimed would take 45 minutes extended to five hours, which made their son unconscious.
The boy later suffered severe seizures at the end of the surgery.
According to the couple, Chinazam’s health had disrupted their lives and caused them psychological trauma.
At the hearing of the matter last Wednesday, Justice Chechey informed the parties involved that the writ of summons and other documents for the case were not physically available because of the e-filing of processes in the state.
The judge further demanded the basis of the matter.
The couple’s counsel, Prof. Akin Ibidapo-Obe, narrated to the court how Chinazam suffered brain damage, remained incapacitated and was confined to a wheelchair following the alleged negligence by the hospital.
Ibidapo-Obe, who gave the judge copies of the filed processes, told the court that Shell, through its lawyers, had filed preliminary objections to stop the suit, adding that he was ready to reply to the technicalities raised by the legal team of Shell led by Michael Amadi.
The couple’s counsel urged the court to give a date to enable the judge to get all documents for the matter.
Justice Chechey adjourned the matter till February 7 and 8 to hear arguments on the preliminary objections.
