Court Sentences Three To Death By Hanging
A Port Harcourt High Court of Rivers State presided over by Justice Adolphus Enebeli has sentenced three persons, Andy Clement Ogbu, Godfrey Handson and Chima Morrison Nwokoma to death by hanging for the kidnapping and murder of a former director of finance and supply, Ministry of Health, late Charles Wogu and Chief Promise Wali on June 1 and 21, 2012 at Rumuokwuta and Woji communities all in Obio/Akpor Local Government Area of the state.
Enebeli, in his 3-hour judgement delivered, yesterday, in Port Harcourt, held that the prosecution was able to judiciously and substantially prove the case of conspiracy, kidnapping and murder brought against the three convicts.
The trial judge while sentencing them after they were found guilty in counts 1 and 2 of the conspiracy charges; and counts 3, 4, 6, and 7, said his hands were tied, and had to do what the law demanded in line with Section 401 and 402 of the State Administration of Criminal Justice Law.
According to him, the convicts contravened Section 1 Sub 1 of the State Anti-Kidnapping Law as well as Section 319 of Criminal Code, adding that the various laws stipulated death by hanging upon conviction.
“You, 1st, 2nd, and 5th defendants, you will be hung until you are dead, and I cannot give you three multiple sentences since you will die once”, he stated.
Enebeli had earlier in the judgement discharged and acquitted the 3rd defendant, Obinna Okerefor; and 6th defendant, Ogechi Innocent Ihunwo of counts 3, 4, 6, and 7 of the kidnapping charges brought against them, as well as counts 1and 2 of the conspiracy charges filed by the state attorney general and commissioner for justice who was the prosecution in the 11-year litigation.
The trial judge ruled that the prosecution failed to provide substantial evidence in the information filed against the two defendants on conspiracy and kidnapping charges, adding that the prosecution relied on mere suspicion, and did not back up the information with credible evidence in the prosecution.
He further struck out charges brought against the 4th defendant, late Rowland Azuka, who reportedly died at the correctional centre during the trial of the matter.
The court further struck out three charges from the initial nine-count charge filed by the state against the defendants, adding that they were duplication in nature.
