Lawyer Sues Bankole, Others Over N2.3bn Car Scam
A legal practitioner and human rights activist, Chief Nkereuwem Akpan, has dragged the Speaker of the House of Representatives Hon Dimeji Bankole, and nine others to court over the N2.3 billion cars purchase by the House in 2008.
On June 9, a group of lawmakers issued a seven-day ultimatum to Bankole to resign over allegations of corruption, high-handedness and causing disaffection between the Senate and the House.
In the suit number FHC/ABJ/CS/409/2010, filed at the Federal High Court, Abuja on Monday, Akpan alleged that the purchase of the cars was riddled with corruption and unbridled gratification.
Joined in the suit were the Deputy Speaker, House of Representatives, Peugeot Automobile of Nigeria Ltd, the Independent Corrupt Practices Commission (ICPC),Economic and Financial Crimes Commission (EFCC), Federal Inland Revenue Service, Inspector General of Police and the Attorney General of the Federation.
The plaintiff in the statement of claim urged the court to declare that the purchase of 380 units of Peugeot 407 cars in 2008 was done “ without lawful authority, illegal void and fraudulent”.
He alleged that both the Speaker and his Deputy, Usman Nafada, should account for N421.5 million, being the money unaccounted for out of the N2.3 billion approved by the House for the purchase of the cars.
Akpan alleged further that the sum of N117.9 million paid as VAT on the contract was “fraudulent and unlawful”.
He also wanted the court to compel both Bankole and his deputy to pay back the difference in the value of the cars to the coffers of the Federal Government within seven days.
The plaintiff averred that the House at its executive session on December 12, 2007, recommended the purchase of PAN 407 Saloon premium pack automatic cars, valued at N6 million as against the PAN 407 Comfort Automatic 20 liter cars, purchased at N6 million as against its selling price of N5.1 million.
Akpan also said there was nothing in the EFCC Act, 2004, requiring the EFCC to submit investigation activities to the Presidency for approval as its Chairman Farida Waziri, recently claimed at a news conference.
He prayed for “an order of mandamus directing the 8th defendant (EFCC) to commence legal proceedings based on its investigation report on the N2.3 billion car scam, without delay”.
