Bayelsa, EFCC Case For Hearing May 24
Justice R. M. Aikawa of the Federal High Court, Yenagoa, has fixed May 24 to adopt the written addresses of counsel in the case between Bayelsa State government and the EFCC.
In the case, some Bayelsa government officials, including the Accountant-General, Mr Francis Okukuro; the Attorney-General, Abbot Clinton and Anthony Ikhobo (applicants) sued the EFCC for detaining them and also questioned its right to probe into the finances of the state.
Other defendants in the suit are the Speaker of the state House of Assembly and its clerk.
Counsel for the applicants, Mr Ifedayo Adedipo (SAN), had in his motion on notice, asked the court for an injunction to restrain the EFCC from probing, freezing and interfering with the financial transactions of Bayelsa.
However, EFCC’s counsel, Mr Festus Keyamo, opposed the motion, saying that there was a criminal case against the state government officials at a Federal High Court, Abuja, coming up on May 19.
Justice Aikawa, however, adjourned hearing of the preliminary objection filed by the applicants to May 24.
The court also struck out the motion on notice by some people to be joined in the suit as defendants.
Keyamo told newsmen after the session that “the court said it will not make any pre-emptive orders except it hears the motion on notice.
“The court was very clear about it that before it makes any definite order, it must hear the motion on notice already filed by them. And we stood by that.”
However, the counsel to the applicants, said “the implicit is that parties shouldn’t do anything that would interfere in any manner whatsoever and howsoever.
“To the subject matter of litigation, I believe that is fair enough and I think and hope that EFCC will live up to that billing by observing the fact that we are in court.”
There was high security presence in the state capital as the Onopa and Hospital junction on the ever-busy Mbiama-Yenagoa road was closed to traffic.
