Don Wants Statute Interpretative Act Reviewed
A university lecturer, Prof. Afeisimi Badaiki, has called for an urgent review of the Statute of Interpretation Act to simplify the dispensation of justice in the country.
Badaiki, who is a Professor of Public Law, made the call, while delivering the 39th Inaugural Lecture Series of the Ambrose Alli University (AAU), Ekpoma in Edo. The lecture was entitled: “Interpretation of Statutes: the Letter or Spirit of the Law’’.
The professor said that “legislative drafting and interpretation that best simplified the language of law and makes it clear, certain and known to the people should be adopted’’.
According to him, if interpretation impedes the understanding of the law, there will be no justification for not excusing the people’s ignorance.
Badaiki suggested a systematic and rational approach, rather than swinging from one type of statutory construction to another.
The present approach to the drafting and interpretation of statute, he said, should be thought afresh, adding that the legislation should be subjected to constant review.
The professor said that the proposed amendment should include declaration of general principles of interpretation.
He equally recommended among other things, education of judicial officers and legal practitioners on statutory interpretation.
Badaiki listed other process that would simplify dispensation of justice to include, application of computers for information retrieval.
He also recommended the devotion of more teaching time and resources by law students, legal practitioners and judicial officers, to linguistic analysis and its application.
