Oshiomhole Tasks NBA On Electoral Law Amendment
Governor Adams Oshiomhole of Edo State, has called on the Nigeria Bar Association (NBA) and the bench to monitor the proposed amendment of the Electoral Law.
Oshiomhole made the call during the NBA conference on the review of performance of the election petition tribunals in Nigeria holding in Benin on Thursday.
He said that the Nigeria Electoral Law was faulty, adding that there was the need for the NBA and the bench to do a proper monitoring so that lawmakers did not amend the law in their favour.
“One major challenge that the NBA and the bench should try to resolve is allowing cases of election to drag on for too long.
“A situation where election petitions are allowed to drag on for three years to four years before judgement is not good for democracy.
“A man who has stolen a goat and a man who has found his way to power through dubious ways have both committed a criminal offence and should be penalised and jailed.”
The governor maintained that there should be a provision in the electoral law allowing political offenders to be penalised for stolen mandate.
According to the governor, the judiciary should have the courage to strengthen the electoral law to sustain democracy and to foster national peace.
“If a man is found perpetuating electoral malpractice or found manipulating INEC, he should be sent to prison to serve as a deterrent to others.”
Oshiomhole urged the NBA to resist any attempt by politicians to use its members to use technicality to forestall truth in the name of interlocutory injunction.
“Lawyers are supposed to advise their clients on what to do in a case, but when lawyers begin to accept frivolous cases and filing injunctions, it portends danger and ridicules the profession.”
Also speaking Gov. Olusegun Mimiko of Ondo State, faulted the process of appointing the chairman and members of the electoral commission including the resident electoral commissioners.
Mimiko said the process allowed for partisan appointment and subsequent recruitment of politically-biased ad-hoc officers who were directly responsible for the conduct of elections.
