Court Remands Two For Illegal Arms
An Asaba Chief Magistrate’s Court, has remanded two men in
prison for alleged illegal possession of arms and unlawfully escaping from the
State Security Service (SSS) custody. The accused persons are Louis Kalama, 26,
and Babyface Perezide, 22.
The SSS Prosecutor, Mr Frank Osas, told the court that the
accused persons committed the offence on October 13, 2011 at Enekorogha in
Burutu Local Government Area of Delta.
Osas also told the court that the accused persons on the
same day and place had in their possession three AK 47 rifles, 197 rounds of
live ammunition and 11 explosives (dynamites).
He said that the accused persons on November 12, 2011,
escaped from SSS custody.
According to him, the offences contravened Section 3(1) of
the Robbery and Firearms (Special Provision) Act, Cap R II Volume 14, Laws of
the Federation of Nigeria, 2004.
They also contravened Section 135 (b) of the Criminal Code
Law, Cap C21, Volume 1, Laws of Delta, 2006.
The Chief Magistrate, Mr Sylvester Ehikwe, who did not take
the plea of the accused persons, said that the case was beyond the jurisdiction
of his court, and ordered that they be remanded in prison.
Ehikwe ordered that duplicate copies of the accused persons’
case file be forwarded to the office of the Director of Public Prosecution
(DPP) for advice. He adjourned the case to August 31 for mention.
