Appeal Court Upholds Akpabio’s Election
The Court of Appeal,
Abuja Division, yesterday dismissed an appeal challenging the election of Governor Godswill Akpabio of Akwa Ibom State.
A former Special Adviser on Projects to Governor Victor Attah, Engr. Frank Okon, had approached the court to challenge the dismissal of a suit in which he challenged Akpabio’s emergence as the Peoples Democratic Party governorship candidate before an Abuja Federal High Court.
Okon had asked the Abuja FHC to return him as the winner of January 15, 2011 Akwa Ibom State re-run primary of the PDP and the subsequent governorship election of April 26, 2011.
But the Abuja FHC had dismissed the case on the grounds that it had no jurisdiction to entertain it.
The court held that it did not consider Okon as a candidate in the re-run primary election.
Dissatisfied with the trial court’s decision, Okon asked the appellate court to set it aside on the grounds that it amounted to a miscarriage of justice.
He argued that he was the candidate of the PDP in the election, having been screened and cleared to participate.
