Rivers People Hail S’Court Ruling On OML 11
Reactions have continued to trail the Supreme Court’s affirmation of the Rivers State Government’s acquisition of Shell Petroleum Development Company’s (SPDC) 45 per cent interest in Oil Mining Licence (OML) 11 oilfields in Ogoni and Kidney Island in Port Harcourt.
SPDC had approached the apex court asking it to set aside the judgement of the Appeal Court which gave 45 per cent equity stake of SPDC in OML 11 and Kidney Island in Port Harcourt to the Rivers State Government.
But the Supreme Court, in its ruling, last Friday, dismissed SPDC’s suit, and also affirmed the Appeal Court’s judgement that awarded N17billion damages against the multinational oil company in 2019.
It would be recalled that in January, 2019, the Supreme Court had upheld the judgement of the Court of Appeal, which awarded N17billion damages against Shell for a devastating oil spill that ravaged farmlands, rivers and streams in Ejama-Ebubu community in Eleme Local Government Area of Rivers State.
However, reacting to last Friday’s judgement, the Chairman of Eleme Local Government Area, Barrister Philip Okparaji, said, “the judgement is a further affirmation that the people have the rights to compensation for the environmental degradation done by the oil exploration and exploitation activities of Shell”.
He commended the Supreme Court “for restoring the hope of the people in the administration of justice system in the country.”
Also reacting, the Transition Ruling Council of the Movement for the Survival of the Ogoni People (MOSOP) applauded the judgement, which was in favour of Ejama-Ebubu community in Eleme Local Government Area of Rivers State over the oil spill that occurred in the community in 1970.
The Chairman of MOSOP Transition Ruling Council, Chief Keeper Gbaranor, said the judgement had vindicated Ogoni people in their campaign for environmental justice.
According to him, “We had said that Shell is on trial, no matter how long it takes, justice must prevail and that’s the signal for oil companies including Shell that think that they can devastate our environment and nobody can confront them. Today, we’re vindicated and have proved that Shell or anybody that is operation in Ogoni will one day be brought to justice”.
On its part, a non-governmental organisation, the Conscience of Ogoni People (COOP), also expressed delight over the Supreme Court’s judgement.
The Leader of COOP, Chief Gani Topba, while congratulating Eleme Local Government Council and the Rivers State Government for the victory, stated that Shell would never win a case where an Ogoniland was involved because the people of Ogoni, according to him, have suffered huge losses as a result of the activities of SPDC.
Meanwhile, the leadership of the Peoples Democratic Party (PDP) in the state has also hailed the apex court’s judgement, saying it was an indication that Governor Nyesom Wike was a frontline emancipator of Rivers people.
The party’s Chairman, Amb Desmond Akawor, described the ruling as a victory for Rivers people, and commended the governor for putting Rivers people first in all his dealings.
