Appeal Court Restrains TSKJ From Leaving Nigeria
The Court of Appeal sitting in Port Harcourt has restrained the Management of TSKJ from removing its assets from Nigeria, pending the final determination of the suit instituted against it by Chief Tobin and Atoni House, all of Finima in the Bonny Local Government Area.
The order follows a motion by Barrister D. Tella Atoni, Counsel to Chief Tobin and Attoni House of Finima, urging the court to stop the company from leaving Nigeria, leaving its liability in the suit behind.
The court presided over by Justice S. Galadima, Justice I.A. Abdullahi also ordered the company to sign an undertaking to ensure its appearance before the court till the final determination of the suit.
It also ordered the management to pay into an escrow account the sum of $700,000. Barrister Attoni in his motion urged the court to order the respondent to show cause why security should not be taken for their appearance, alleging that the company has been auctioning its assets in Bonny preparatory to leaving Nigeria. The territorial jurisdiction of Court of Appeal, arguing that except the company is restrained, the decision of the court will be of no effect.
He also informed the court that one Mr M. Larkin the second cross appellant in the matter has escaped from Nigeria.
