Court Restrains Sons From Inheriting Father’s Estate
A Port Harcourt High Court presided over by Justice M. O. Opara, has declared that Goodluck Aator, Bari-Aara Aator and Dormu Aator 1st, 2nd and 3rd defendants are not the biological children of late Nafirima Vizor Zabbe.
Justice Opara further declared that the aforementioned persons cannot inherit the estate/property (moveable and immoveable) of late Nafirima Vizor, situated anywhere in Gokana local government.
The judge also affirmed that the fourth defendant, Madam Leka Aator is not the wife of late Nafirima Vizor Zabbe of Mogho community in Gokana Local Government Area.
The court granted a perpetual injunction restraining the defendants, their privies, agents, servants or howsoever from committing further acts of trespass on the property/estate of the late Zabbe of Mogho community.
Earlier, in a suit reference No. BHC/11/2008, the claimants: Chief Michael Vizor Zabbe, Madam Mary Vizor Zabbe and Madam Bariton Vizor Zabbe prayed the court not allow the first, second and third defendants to inherit the estate/property of late Zabbe.
The claimants further urged the court to declare that Madam Leka Aator was not married to late Zabbe according to native law and custom and therefore her children cannot bear the family name of late Zabbe and therefore cannot inherit Zabbe’s esate/property.
