Court Sacks Senator Joy Emordi
The election of Senator Joy Emordi of the Peoples Democratic Party (PDP) representing Anambra North Senatorial District of Anambra State was on Monday nullified by the Appeal Court sitting in Enugu which ordered the Independent National Electoral Commission (INEC)to immediately withdraw her certificate of return.
Delivering the unanimous judgment, Justice Olu Ariwola said there was substantial evidence before the court that election did not take place in Anyamelum and Onitsha South, adding that the results from the two local government areas were inadmissible before the court.
Justice Ariwola also ordered INEC to issue a fresh certificate of return to Mr Alphonsus Uba Igbeke of the All Nigerian People Party as senator elect for Anambra North Senatorial District
..He further maintained that Igbeke polled majority of the votes cast in five local government areas, namely, Oyi, Anambra East, Anambra West, Onitsha North and Ogbaru, where the ANPP candidate polled over 175,000 votes against 29,000 by Emordi of PDP based on the evidence before the court
”We therefore order the Independent National Electoral Commission to withdraw certificate of return issued to Emordi and issue a new certificate of return to Igbeke as winner of April 28, 2007 Senatorial election in Anambra North District”. he said
Igbeke had approached the election Tribunal to challenge the emergence of Emordi as senator representing Anambra North Senatorial Zone following the April 28, 2007, insisting that he ought to have been declared winner.
In his reaction Emordi’s counsel, Hypolite Onwuegbuka said that he accepts the judgment as a lawyer.
