Yar’Adua: Falana Faults Court Decision
Human Rights activitist and eminent lawyer, Femi Falana has faulted the Federal High Court decision on Yar’Adua, calling on the Chief Judge of the Federal High Court, Justice Daniel Abutu to avoid controversies.
Falana mainatained that Justice Abutu should avoid presiding over a case he instituted against the prolonged absence of President Yar’Adua.
According to the human rights lawyer, the call became imperative because of the verdict delivered by Justice Abutu Tuesday in a similar suit.
Falana expressed optimism in getting justice in another court as against Justice Abutu’s court
It would be recalled that Justice Abutu had ruled on Tuesday in a suit brought before him that Vice President Goodluck Jonathan c an only exercise presidential powers if only it was conferred on him by Yar’Adua.
He however, declared that Vice President Jonathan could go ahead to exercise the powers of the ailing president pending the latter’s recovery and return to the country.
Justice Abutu who gave the ruling on a suit filed by Amobi Nzelu on behalf of another lawyer, Christopher Onumekwe said the failure of Yar’Adua to transmit a letter to the National Assembly, informing it of his medical trip to Saudi Arabia and his desire for Jonathan to perform his duties until his return, has made it impossible for the latter to energe as acting president.
The judge held that even before the suit, ‘ the Vice President has been carrying out the duties of the president as allowed by the constitution in section 5 (1) of the 1999 Constitution.
Speaking with reporters after the judgement, the Attorney General of the Federation and Justice Minister, Chief Michael Aondoakaa said the court’s prouncement has confirmed that no other person can question the vice president for performing the functions of the president.
He stressed that the court has now cleared the way for the vice president to sign any bill or any papers which requires the president’s attention.
