The Rivers State Government has reminded the Economic and Financial Crimes Commission (EFCC) that there are subsisting judgments of the Federal High Court that bar the commission or any investigating agency to question or probe the accounts of the state government.
The Attorney General and Commissioner for Justice, Worgu Boms, who stated this on Wednesday while speaking to journalists after Hon Chidi Lloyd was granted bail, charged the commission to respect the laws of the land.
He argued that those judgements were in existence before Rt Hon Chibuike Amaechi became Governor of Rivers State.
Boms warned that no attempt should be made to cow or intimidate anybody in the course of their official duties, stressing that it would be nice if the EFCC will respect the laws and obey the subsisting judgement of the Federal High Court.
The attorney general dismissed insinuations that he might discontinue with the case having taken over the case from the police, saying that “time will judge everything”.
According to him, “this idea of trying to find out by mysterious means is not appealing to me at all. I have been here and somebody is suggesting what I will do in future. I don’t know. As matters progress, lawyers take decisions based on realities on the ground.
“Today, the court saw it fit to grant bail to the accused person, Hon Chidi Julius Lloyd and we adjourned till 21st of November, 2013 to take a motion filed by the defence to cease the charge or to hear the matter if that motion is not taken”, he said.
On the bail granted to the House leader, Boms said, “bail is at the discretion of the court. Whatever condition the court gives, the court must have looked at it to say that it will best secure the attendance of that person”.
He said, “if Hon Chidi Lloyd had done anything in the past before now, why are they (EFCC) coming now at the thick of the matter when we believe that he (Lloyd) may be granted bail. This approach to law enforcement ridicules the system; it ridicules the legal system. So, what they are saying is that it does not matter what you do in court; what matters is what the individual feels at any given point and it is unfortunate”.
He, however, appealed to everybody, regardless of the factions, to ensure they act within the laws.
“When we act out of the law, we cannot be gathered here. It is in the best interest of everybody to act within the law. I speak with all sense of duty. No amount of intimidation or choreography or subtle threat will stop any responsible person from doing his job. In that respect, I would like to advise the police, in fact, I appeal to the police to take steps to arrest all the other lawmakers in the Assembly, who from the video we saw, also played a role in the matter that brought us to court. That is my appeal to the police”, he said.
Boms charged those other persons to also emulate the accused person and surrender themselves to the police so that everybody would be brought to court to answer  to what happened in the Assembly complex.
He said “now that Chidi Lloyd is here, every other person should come so that I will prosecute all the persons involved”, adding that, “to bring one person here and be orchestrating some machinations will not work”.
