Dr. A.C.B Agbazuere has filed a suit before an Abuja Federal High Court, seeking a declaration by the court that the appointment of Dr Emeka Ezeogo Onuoha as the new chairman of Aba State Chapter of the Progressive Peoples Alliance (PPA) by the National Working Committee of the party is null and void. Agbazuere who joined the PP A and Onuoha as 1 st and 2nd respondents respectively in the Suit Numb\u2019er CV\/l72 3\/09, filed by his counsel, Mr Femi Falana (Esq.) on july 3, 2009, is also asking the court to declare that Onuoha, not being elected by the State Congress of the party as an officer of the State Executive Committee of Abia PPA before his appointment as its chairman, was not qualified to replace the former Chairman and therefore his appointment is null and void.<\/p>\n
Other reliefs being sought by the plaintiff include an order of the court setting aside the May 8th, 2009 letter which appointed the 2nd defendant as chairman of Abia PP A as well as another order restraining him from parading himself as such.<\/p>\n
Agbazuere is also praying the court to compel the 1 st defendant to allow the Executive Committee of the Abia PPA to appoint an officer from amongst themselves to fill the vacant position of chairmanship of the state chapter of the party.<\/p>\n
In a 22 paragraph affidavit in support of the originating summons, Agbazuere, who is the Executive chairman of Isiala Ngwa South local government area of Abia State averred that he is a member of the State congress of the party in Abia expressly vested with the responsibility of electing officers of the State Executive Committee by the party constitution.<\/p>\n
The plaintiff further stated that the appointment of the 2nd defendant by the National Working Committee of the party was an imposition since it contradicted PP A\u2019s constitution, adding that the 2nd defendant was already using his \u201cunconstitutionally acquired position to victimse\u201d him.<\/p>\n
\u201cI am taking this action to salvage the Ist defendant and ensure that it retains its credibility before th\u2019e eyes of the members of the public as well as ensuring that the observance of rule of law within the party.\u201d Agbazuere stated.<\/p>\n
