The Peoples Democratic Party (PDP) has declared that former Acting National Chairman of the party, Senator Ali Modu Sheriff,\u00a0 was validly removed by the legally constituted\u00a0 May 21, 2016 National\u00a0 Convention\u00a0 of the party which held in Port Harcourt .
\nThe PDP further declared that the caretaker committee\u00a0 of the party headed by Senator\u00a0 Ahmed Makarfi was duly appointed\u00a0 in line with the\u00a0 Constitution\u00a0 of\u00a0 the\u00a0 party.
\nThe party stated that the National\u00a0 Convention\u00a0 was convened by the National Executive Committee headed by\u00a0 the\u00a0 former Acting National Chairman,\u00a0 Senator Modu Sheriff,\u00a0 who himself\u00a0 participated in pre-convention events including\u00a0 his participation\u00a0 in the screening\u00a0 exercise.
\nCounsel to the PDP, Oladejo\u00a0 Lamikanra, a Senior Advocate of Nigeria (SAN) told the Federal\u00a0 High Court, yesterday, in Port Harcourt, presided over by Justice\u00a0 Abdullahi\u00a0 Liman, in an originating\u00a0 summons that: \u201cModu Sheriff\u00a0 submitted himself\u00a0 for screening at the Port Harcourt National Convention. Realising that he has lost his bid to be National Chairman, Modu Sheriff\u00a0 alone without consent and consultations with the\u00a0 National Executive Committee\u00a0 claimed he postponed the convention. Modu Sheriff\u00a0 had no such powers to postpone a convention approved by the National Executive Committee. \u201c
\nLamikanra further argued that: \u201cModu Sheriff\u00a0 is not the chairman\u00a0 of\u00a0 PDP. He was never elected at any convention and he is subject to the extant judgment of A.B. Mohammed of FCT High Court, which Modu Sheriff is curiously\u00a0 seeking\u00a0 to\u00a0 enforce.
\n\u201cThe FCT High Court Justice A.B. Mohammed had in judgment\u00a0 of 18 May 2016 in FCT\/CV\/1443\/2016 rejected\u00a0 Modu Sheriff\u2019s\u00a0 argument\u00a0 that he is PDP\u00a0 Chairman\u00a0 until 2016. \u201c
\nThe PDP\u00a0 argued that no court stopped the party from holding its National Convention. It added that the National Constitution\u00a0 of\u00a0 the\u00a0 PDP\u00a0 was also never suspended, hence, the National\u00a0 Convention derived its powers from the party\u2019s\u00a0 constitution.
\nThe party\u00a0 stated that the interim order of the Federal\u00a0 High Court sitting in Port Harcourt\u00a0 stopping\u00a0 Modu\u00a0 Sheriff from parading himself\u00a0 as PDP\u00a0 Chairman\u00a0 was still subsisting.
\nThe\u00a0 PDP\u00a0 stated, \u201cthe Interim Orders could not possibly lapse when Modu Sheriff had an application\u00a0 asking\u00a0 court to set aside same order. It could not possibly\u00a0 lapse when Modu\u00a0 Sheriff was asking\u00a0 the\u00a0 name PDP\u00a0 to be struck\u00a0 out\u00a0 from the suit.
\n\u201cAn interim order met with the applications\u00a0 mentioned\u00a0 does not lapse until 14 days after arguments are taken. That is 14 days from May 16, 2016\u201d.
\nHe noted that the suit was filed by the PDP and not Senator Ahmed Makarfi\u00a0 and Senator Ben Obi\u00a0 as claimed by the Former\u00a0 Acting\u00a0 National Chairman of the party.
\nEarlier, former Acting National Chairman of PDP, Senator Ali Modu Sheriff, had urged the court to dismiss\u00a0 the\u00a0 originating summons.
\nThe former Acting\u00a0 National Chairman through\u00a0 his counsel, Ajibola Oluyode filed applications\u00a0 asking the court to set aside the interim order directing\u00a0 him to stop parading himself\u00a0 as Acting National\u00a0 Chairman.
\nThe former acting National\u00a0 Chairman\u00a0 also urged the court to strike out the name PDP\u00a0 from the suit\u00a0 and subsequently\u00a0 struck it out.
