Court Bars Amaewhule, Others From Further Impeachment Moves Against Fubara, Odu

A Rivers State High Court sitting in Oyigbo Local Government Area has issued an interim order of injunction restraining the Speaker of the Rivers State House of Assembly, Hon. Martin Amaewhule, and 32 others from taking further steps in an alleged impeachment process against Governor Siminalayi Fubara and his deputy, Prof. Ngozi Odu.

 

Justice F. A. Fiberesima of the State High Court in Oyigbo Local Government Area of Rivers State granted the order following an ex parte motion filed by Governor Fubara and his deputy, Prof. Odu.

 

Justice Fiberesima also restrained the Chief Judge of Rivers State, Justice Simeon Chibuzor-Amadi, who was listed as the 32nd defendant, from receiving, forwarding, considering or acting on any request, resolution, articles of impeachment or related communication.

 

The Court specifically barred any action aimed at constituting a panel to investigate the alleged misconduct of the governor and his deputy for a period of seven days.

 

The injunction also applies to the Speaker, the Clerk of the Rivers State House of Assembly and 30 other defendants named in the suit.

 

In his ruling, Justice Fiberesima granted leave to the claimants to serve the interim Order, originating processes and all other court documents on the first to the 31st defendants.

 

The court further directed that service on these defendants be effected by pasting the court processes at the gate of the Rivers State House of Assembly Quarters.

 

With respect to the Chief Judge, the Court ordered that the processes be served through any staff of the Rivers State Judiciary at the Chief Judge’s Chambers within the High Court premises.

 

The court held that the interim measures were necessary to preserve the subject matter of the suit pending the determination of the motion on notice.

 

Justice Fiberesima emphasized that the order was temporary and intended to maintain the status quo.

 

He, thereafter, adjourned the matter to Friday January 23, 2026 for further hearing on the motion on notice.
