A High Court sitting in Port Harcourt has vacated an earlier court order restraining the Paramount Ruler of Ogbogoro Community in Obio/Akpor Local Government Area of the State, Eze Felix Amadi, from parading himself as the Paramount Ruler of the community.
The court, presided over by Justice Chinwendu Nworgu, had issued an order of interim injunction against Eze Felix Amadi, his servants, privies, or anybody whatsoever from further sales of Rumukpalikwu-Ada family land without the consent of the authorities of Rumukpalikwu-Ada principal family members.
Justice Nworgu after listening to the argument by Counsels representing the parties when the matter came up for motion on notice, agreed with the defendant’s Counsel and subsequently vacated the order and adjourned till 18th of October, 2023 for hearing on the interlocutory injunction and other pending motions.
Speaking to newsmen outside the courtroom, the Counsel to Rumukpalikwu-Ada Royal family and Ehiosi family, Obinna Wondah explained what transpired in court and the reasons for the decision of the judge.
Wondah said the position of the court did not touch on the suspension by the family members.
“What the court did was to vacate the interim order that it extended on the 11th day of July 2023. The court vacated the order because the order has elapsed. Ordinarily, by law, the order was supposed to elapse after seven days but because of the extension, the court extended it and it elapse today”, he said.
He also noted that the it was vacated and adjourned to the 18th of October 2023 for Motion, due to plethora of Motions pending.
One of such, he noted, was the one challenging the jurisdiction of the court and the other asking the court to stay proceedings.
Meanwhile, a member of the Rumukpalikwu-Ada Royal family, Anderson Amadi, has clarified that their suspension against Eze Felix Amadi still stands, irrespective of the new vacating order of the court.
“The court in its wisdom said, due to the pending Motions and Applications before it, it decided to lift the suspension. It has nothing to do with the family suspension, the family suspension is still intact “, he said.
He also warned members of the public against having any dealing with the monarch in the name of representing the Royal family.
“There is information making the rounds that the family hall is about to be sold out. We are calling on every intending buyer not to deal with him, and the hall is also not for sale”, he said.
