PH Lawyer Flays Abia Governorship Poll Judgement
A Port Harcourt based
lawyer, Barr. Isaiah Kanwi, has described the judgement of the Federal High Court, Abuja on Abia State governorship poll as a travesty of justice.
Barr. Kanwi, who stated this while speaking with newsmen in Port Harcourt yesterday, noted that the court’s decision had fallen short of the provisions of section 142 of the Electoral Act, 2010.
He noted that the declatory orders made by Justice Okon Abam of the Federal High Court Abuja were ultra-vires because according to him, the court did not have jurisdiction to make such orders.
Barr. Kanwi noted that “where a court assumes jurisdiction on a matter it ought not to have, the whole process is a nullity.”
He stated the issues for determination were post-election matters and ought not be in a Federal High Court.
The Port Harcourt lawyer also explained that Dr. Ugah was not in court to challenge Governor Okezie Ikpeazu and expressed surprise why the Federal High Court could grant reliefs to someone who was not in court.
He pointed out that the court was never a father Christmas who gave out things to people unasked.
Barr. Kanwi noted that there were relevant Supreme Court decision on the fact that the court was not a father Christmas and could not give reliefs unasked to people .
He, however, urged Abians to exercise patience and watch things unfold in the state.
