Wike May Be Sworn-In Under Doctrine Of Necessity – Lawyer

based legal practitioner, Barr. Chijioke Agi, has said that in the absence of a Chief Judge to swear-in the governor-elect Barr. Nyesom Wike, on May 29, 2015, the doctrine of necessity may apply to fore-close vacuum.
Barr. Agi who spoke with The Tide in Port Harcourt at the weekend, noted that the doctrine of necessity comes in place to do the needful and to foreclose the creation of vacuum in a system.
According to him, the state will not just be thrown into crisis because of the absence of a chief judge but must find a way to wriggle out the problem to allow the state move forward.
He remarked that the National Judicial Council in the absence of a Chief Judge in Rivers State had given Justice Daisy Okocha the power to act administratively and pointed out that she might be the one to swear-in the governor, Barr. Nyesom Wike, as the executive governor, Rivers State.
The Port Harcourt lawyer expressed regrets that every issue in the state was being politicised.
He said where issues arose the courts be the final arbiter.
On whether the application of doctrine of necessity would require judicial pronouncement, he said that it did not require.
He explained that those who were comfortable with the doctrine of necessity applied could seek redress in a court of law.
Barr. Agi urged Rivers people to join hands to move the state forward.
