The plantiff respondent had a moped acci
dent on road in the premises of the defendant’s appellant institute. The plaintiff alleged that a deposit of sand negligently left along the road had caused the accident. The Court of Appeal. Ibadan division held: That the action failed as negligence was not proved on the part of the defendant institute.
