Court Remands Accused In Custody For Murder

A middle aged man,
Synenye Nnakuruba, 20 has been remanded in prison custody by a Port Harcourt Chief Magistrate for an alleged murder case on charge sheet number pmc/553c/2014.
The accused person, Synenye Nnakuruba, 20 is standing trial on two count charge of murder and other criminal matters before Chief Magistrate Ipalibo F. Iyiabo.
The prosecuting police officer, Insp Wilson Isaiah told the court that the accused person and others at large on the 10th day of February, 2014 at Nyokwa Okwale community in the Port Harcourt Magisterial District did conspired among themselves to commit felony to wit murder.
The prosecution further told the court that the accused persons on the same date and place in the afore- said magisterial district unlawfully murdered one Tambari Adoo by cutting off his head with machete adding that the accused person committed an offence punishable under section 324 and 3191 of the Criminal Code cap 37 Vol. 11 Laws of Rivers State of Nigeria 1999.
The charge was read to the accused person but he was not allowed to take plea on any of the charge.
Remanding the accused in prison custody the presiding Chief Magistrate Court 2, I.F. Iyiabo declined jurisdiction on the grounds that the court lacks the power to entertain the matter based on the offence as charged  by the prosecution.
He ordered that the original case file be remitted to the office of DPP for their legal advice on the matter.       However, he advised the accused person that be was at liberty to approach the high court for his bail and later adjourned the matter to May 8, 2014 for DPP’s Advice.
