Court Discharges Two Robbery Suspects
An Enugu High Court pre
sided over by Justice Afamefuna Nwobodo has discharged two men accused of armed robbery for poor representation by the prosecution counsel.
Nwobodo last Tuesday discharged the accused, Ifeanyi Ezeoke and Ifeanyi Egele for the inability of the prosecutor to handle their cases diligently.
Ezeoke and Egele were accused of robbing one Tochukwu Ezeiruaku and others of their belongings on July 29, 2009 on Port Harcourt Street, Ogui New Layout in Enugu.
The counsel to Ezeoke, Mr Benjamin Nebe, told the court that the state counsel, Mr Ameachi Ngene, had not been able to bring witnesses to testify in court.
“Although he brought one witness to the case, he has failed to bring the other ones as he promised.
“Besides, the counsel has not shown any seriousness in the prosecution of this case as he hardly appears in court,” Nebe said.
The counsel to Egele, Mr Kester Nebo, pleaded with the court to discharge the accused persons pending when the state was ready to prosecute the matter.
“The accused persons have been languishing in prison since 2009 while this case has been in court since 2011.“We should have been talking of the judgement by now but the state counsel has failed to bring his witnesses to court,” Nebo said.
The court, however, discharged the accused persons for lack of diligence by the state counsel.
