Court Restrains FCDA From Demolishing Property Of Sahara Estate
An FCT High Court last Thursday granted an order of interim injunction restraining the Federal Capital Development Authority from further demolishing a property belonging to Sahara Estate in Kafe District, Abuja.
The vacation judge, Justice Musa Othman, gave the order after counsel to Sahara, Mr Paul Eshiemomoh, filed a motion seeking for an order restraining the FCDA from demolishing the property.
Othman said that the order was granted, pending hearing and determination of the substantive suit.
“ I have carefully listened to the oral submissions of counsel to the plaintiff and the addresses attached therein.
“And I am satisfied with the submission of the plaintiff,’’ he said.
The judge ordered that both parties should maintain status quo, pending the determination of the case.
Othman also ordered the applicant to serve the respondent with the notice through a substitute means.
However, Eshiemomoh told the court that the plaintiff, Mr Christian Audu, built a three-bedroom detached bungalow on plot 55 Cadastral Zone C05, Kafe District.
He said that the plaintiff bought the land from Sahara Estate Developers in 2005.
The case was adjourned to January 6 for hearing
