Man In Custody For Possession Of Firearms
A twenty year old
man, Kaka Victor and others now at large have been remanded in prison by a Port Harcourt Chief Magistrate Court for alleged possession of illegal fire arms.
The accused person, Kaka Victor and others now at large are standing trial on two court charge before Chief Magistrate Emmanuel C. Woke on felony and unlawful possession of fire arms.
The police prosecution told the court that the accused persons on the 19th August, 2013 at Buguma in Asari Toru Local Government Area of the state in the Port Harcourt magisterial district did conspire among themselves to commit felony to wit: unlawful possession of fire arms.
The prosecution further told the court that the accused persons on the same date and place in the afore said magisterial district did have in their possession, three Ak49 riffles No 56 128027437, 49022651 an 56-1×18012358, two magazines and twelve rounds of 7.62mm live ammunition.
The prosecution averred that the accused persons have the intent to use the guns for robbery, adding that they committed an offence punishable under section 6(b) and 3(1) of the Robbery and Fire Arms (special provision) Act cap R11 laws of the federation of Nigeria 2004.
In his ruling, the presiding chief magistrate, E.C. Woke while remanding the accused person to prison custody on the ground of lack of jurisdiction, ordered that the case file be forwarded to the office of Director of Public Prosecution (DPP) for legal advice.
He, however, told the accused that he is at liberty to approach a high court for his bail and adjourn the matter to the 6th of December 2013 for DPP’s advice.
