Estate Firm Gets Court Order Over Bank Accounts
An FCT High Court sitting
in Gwagwalada last Monday granted a ‘garnishee order nisi’ on four bank accounts belonging to an estate company, Split Second International Limited.
Garnishee order nisi, is a legal procedure by which a creditor can collect what a debtor owes by reaching the debtor’s property when it is in the hands of someone other than the debtor.
Justice Balami Mwada, gave the order, following a motion exparte brought by Mr Promise Mbani, counsel to Mr. Akinwuni Ajibola.
The defendant’s bank account number affected by the order are: Guaranty Trust Bank Plc., 321214016110 and 32124016120; Fidelity Bank Plc; 4010612658; and Keystone Bank Plc 1005363895 within the court’s jurisdiction.
Mwada explained that the court granted the prayers to enable Ajibola recover a judgment debt of N45 million paid as part payment for the construction of six units duplexes.
The Judge said that the defendant would also pay 10 percent interest rate on judgement sum, totalling N54.5 million.
“Upon hearing the motion exparte and accompanying affidavit of promise, Mbani, a garnishee order nisi is hereby granted.
A garnishee order nisi attracting the sum of N54 million and a 10 percent interest rate on judgement sum from the date of judgment until final liquidation is hereby given. The order is made to enable the creditor recover his money,” he said.
The court also ordered the banks to appear before it to explain why they could not pay to the plaintiff the entire judgement sum toward the satisfaction of the debt.
Ajibola had sued the estate company, Split Second International Ltd, for refusing to refund N54 million he paid for the completion of six units of duplexes, which the company agreed to execute in three months, but failed.
