Court Remands Two For Armed Robbery, Rape

A Port Harcourt Chief Magistrate Court presided over by Emmanuel C. Woke has remanded two accused persons in prison custody for an alleged armed robbery and rape offences on charge No PMC/1782c/2013.
The accused persons, Bright Omuku, 19 and Nosike Sunny, 18 are standing trial on three court charge of armed robbery, in possession of dangerous weapons and rape before Chief Magistrate E.C. Woke.
The prosecution told the court that the accused persons on the 4th July, 2013 at Omuku Street, Port Harcourt in the Port Harcourt magisterial district did conspired among themselves to commit felony to wit: armed robbery.
The prosecution further told the court that the accused persons on the same date and place while armed with locally made double barrel gun did robbed one Chinoso Johnson (F) of the sum of one thousand, one hundred and twenty naira, only.
The prosecution also averred that the accused persons on the same date and place did have unlawful carnal knowledge of Chinoso Johnson (F) and thereby committed an offence punishable under section 6 (b) and section 1 (2)(b) of the armed robbery, and fire arms (special provision) Act Cap II Laws of the Federation 2004 and section 358 of the criminal code cap 37 Vol laws of Rivers State of Nigeria 1999.
The accused persons, however, did not take plea in the charges brought against them.
In his ruling, the presiding Chief Magistrate, E.C. Woke ordered that the accused persons be remanded in prison custody while their original case file be forwarded to the DPP for legal advice.
The presiding Chief Magistrate while adjourning the case to November 11th 2013 for hearing told the accused persons that they are at liberty to approach a high court for their bail.
