Court Remands Man, 36, Over Alleged Robbery

A 36-year-old man, Precious Atouchi Napoleon has been remanded in prison custody by a Port Harcourt Chief Magistrate Court presided over by Emmanuel C. Woke for alleged robbery offences and other criminal matters.

The accused person, Precious Atouchi Napoleon, 36, is standing trial on five court charge on conspiracy, robbery, possession of illegal arms and stealing before E.C. Woke with charge number PMC/1109c/2013.

The police prosecution alleged that the accused person on the 22nd May, 2013 at the Rivers State University of Science and Technology Port Harcourt in the Port Harcourt magisterial district conspired to commit Felony to wit: armed robbery, adding that the accused while armed with guns and other dangerous weapons robbed one Bartha Oriaku (F) of the sum of seven hundred naira (700.00), one Nokia CI Phone valued at five thousand and five hundred naira (N5,500) totaling six thousand and two hundred naira (6,200).

The police prosecution also alleged that the accused persons and others now at large on the same date and place within the aforesaid magisterial district while armed with guns and other dangerous weapons robbed one Samuel Bennett (m) of one Nokia Asha prone valued at twelve thousand five hundred naira (12,500), as well as robbing one Loveday Felix of a Black Berry Bold 2 phone value at sixty thousand naira (N60,000).

The prosecution further alleged that the accused while armed with guns did robbed one Black berry 9700 bold 27 mobile phone valued at twenty four thousand naira (24,000) and thereby committed an offence punishable under section 2 (a) of the robbery and fire arms (special provision) Act cap R11  laws of federation 2004.

In his ruling the presiding Chief Magistrate E.C.Woke declined jurisdiction and ordered that  the accused be remanded in prison custody.

The presiding Chief Magistrate further directed that the case file be forwarded to the Director Pubic Prosecution DPP for Legal Advice and later adjourned the matter to 9th August 2013 for DPP advice.
