Court Remands Accused Over Murder

A 24 year-old man, Chibuike Dozie, has been remanded in prison custody for allegedly murdering a pregnant  woman and her unborn child by  a Port Harcourt senior magistrate court with charge number, PMC 333c/13.

The accused person, Chibuike Dozie is standing trial  on two  court charge on murder and other criminal offences before Senior Magistrate, Daisy Wonjoku.

The Prosecuting Police Officer, Sergent Ikosi  Omanoye, told the court that the accused person on the 24th of January , 2013, at Rumuekeni community within the jurisdiction of the Port Harcourt magisterial  district did murder  one Florence Victor Osi by hitting her with his elbow on her stomach.

The police prosecutor also told the court that the accused person on the same date and place did cause the death of the unborn child of the deceased, Late Florence Victor Osi by hitting her mother with his left elbow on her stomach adding that such attack by the accused person led to the death of the un-born child in the womb of the deceased.

The prosecutor  averred that the accused committed an offence punishable under section  319 (1) and 328 of the criminal code cap  37 vol. II laws of Rivers State of Nigeria 1999.

In her ruling, the Presiding Senior  Magistrate, Daisy Wanjoku declined jurisdiction on the matter and ordered that the accused person be remanded in prison custody. She, further directed the police  prosecutor to forward the original  case  file to the court registrar  for onward transmission  to DPP for legal  advice  on the matter.

She,  however, declared that the accused  person is at liberty to approach  a High Court for his bail and adjourned the case to  28th of May, 2013 for continuation.
