Two In Court For Alleged Stealing

Two persons, Tochukwu Iwuoha, 20, and Emmanuel Duru, 15 have appeared before a Port Harcourt Magistrate Court for conspiracy and stealing.

The accused persons are standing trial on four court charge of conspiracy, stealing and others before Chief Magistrate Ipalibo Iyiabo.

The police prosecutor, inspector, Wilson Isaiah told the court that the accused persons and others now at large on the 22nd of January, 2013 at Railway line, Mile I Diobu, Port Harcourt in the Port Harcourt magisterial district conspired among themselves to commit Felony to wit: stealing.

The prosecutor further told the court that the accused persons on the same date, time and place in the aforesaid magisterial district did steal the sum of Twenty-Five Thousand Naira (25,000.00) property of one Ayogu Fidelis adding that the accused persons gave the complainant (Ayogu Fedelis) fist blows all over his body.

The prosecution also alleged that the accused persons on the same date, time and place did have in their possession one Techno handset, one Nokia 201 and one Nokia FM Torch light which they could not account for when the police interrogated them.

He noted that the accused persons committed an offence punishable under section 516A, 390(9), 351 and 430(1) of the criminal code laws of Rivers State of Nigeria 1999.

The accused persons pleaded not guilty on the four court charges brought against them.

In his ruling, the presiding Chief Magistrate, Ipalibo Iyiabo granted the accused bail N250,000 each, one surety each in like sum.

He further directed that the suretees must deposit two passport size photograph each and must reside within the jurisdiction of court. He later adjourned the case to 14th March, 2013 for definite hearing.
