Two In Court For Alleged Burglary

Two young men have been arraigned before a Port Harcourt Chief Magistrate Court presided over by I.F Iyiabo.

The accused persons, Humphrey Oduobi (28) and Samuel Onogboduta, 24, are standing trial on three count  charge of burglary, break and entry and stealing.

The prosecuting police officer, Inspector Wilson Isaiah told  the court  that the accused persons and others now at large on January 2, 2013 at JAFAC Construction Company Nigeria Limited Km18, Airport Road, Igwuruta, in Port Harcourt Magisterial  District did  conspire among themselves  to commit felony to wit burglary.

The  police prosecutor also said on the same date and place did  unlawfully break and enter into the office by damaging part of the building of the company.

The prosecution further  alleged that the accused persons also stole 6  ship propellers, 2  heavy duty generator AVRs, 2 kick starters for the heavy duty generator, 2 heavy duty batteries, 2 rolls of welding cable, adding that the total value of  property stolen is N11,014,300.00 property of one Chinyere 1999.

He averred that the accused committed  an offence  punishable  under section 51 6A (I), 4B (I) (2) and (390) of the criminal code cap 37, Vol II laws of Rivers Sate of Nigeria 1999.

The accused persons  pleaded  not guilty to all the charges brought against them.

In his ruling, the presiding Chief  Magistrate, Ipalibo Iyiabo after listening to the defence counsel directed the case file for the matter to be returned to the  OC Legal police for the re-drafting of the charges. The matter was  adjourned to today for continuation.
