Court Strikes Out Case Over Death Of Accused

An Elele
Magistrate Court in Ikwerre Local Government Area of Rivers State, has struck
out a fatal accident case against Sefa Abasi, accused person, following his
death.

The presiding magistrate, Mr C. Okey in
his ruling stated that death was the end of criminal litigation. According to
him, no proceeding could lie against the accused person when he is dead.

“The court could not proceed against the
dead. The magistrate, who struck out the matter yesterday regretted that the
accused person had to obey the ultimate call at this.

Abasi had killed a 12 year-old Miss O.
Enyie in a motor accident within the jurisdiction of the court.

Mr Abasi had opted to negotiate with the
parents of the deceased Miss Ordu.

The Tide learnt that the
accused person, Late Mr Sefa Abasi had contracted an illness while in the
prison custody, which resulted in his death.
