Firm Seeks Damages Against Police, Creditors

The Managing Director of Dave Global Concept Nigeria Ltd, Mr David Nwankwo is seeking damages at the Federal High Court, Port Harcourt against the creditors of his company for the violation of his fundamental rights.

The MD, who  spoke with The Tide in Port Harcourt at the weekend noted that Dave Global Concept Nigeria Ltd’s creditor had continually violated his fundamental rights by often ordering his arrest and detention as a result of the debt his firm was owing them.

Mr Nwankwo stated that the continual harassment by the police at the instance of the firm’s creditors were unbecoming and unbearable.

According to him, “my firm enjoys a limited liability status so I can’t understand why the debt of the firm should be made a personal thing”.

He said he had to sue the Commissioner of Police Rivers State and 24 others for the gross violation of his fundamental rights.

Mr Nwankwo pointed out that the police had no business in the recovery of debt.

He regretted that the creditor firms and individual were the firms former suppliers who could not be paid promptly as a result had resorted to self help.

The MD flayed the creditors for not using the appropriate means to recover their debt, and pointed out that Dave Global Concept Nig Ltd was a responsible firm that was ready to pay its debts but not through harassment and intimidation.

He stated that his firm which was a supplier of food to vessels on the sea had suffered economic depression in latter part of 2012 which resulted to the present debt profile.

Mr Nwankwo said that the firm and its creditors had worked out a peaceful way of settling the debt but expressed regret that some of the creditors were still recalcitrant.

He noted that he headed to court because of continual violation of his rights as a person.

The MD said he was seeking damages for the wanton violation and an order of injunctioning restraining the respondents (creditors & police) from any further violation.

The 28th of May 2012 is stated for the hearing of the motion on notice.
