Court To Hear Preliminary Objection In May
A Port Harcourt High Court presided over by Hon. Justice E. N. Ogbuji has adjourned to the 29th of May 2012 for further hearing a motion challenging the competence of his court to continuously entertain a suit between some spy police officers of Total E and P and the management of the company over their wrongful dismissal.
Counsel to the Total E and P, T. J. Krukrubo has raised a motion questioning the jurisdiction of the court over the issue.
He argued that since the matter is an industrial issue, it should be transferred to the industrial court.
He also said that the matter is not within the jurisdictional competence of the High Court.
Counsel to the plaintiff, Femi Falana represented by Stanley Emahoro asked for adjournment to enable him respond to the motion.
The matter was therefore adjourned to the 29th of May 2012.
It would be recalled that a Port Harcourt Court of Appeal has recently ruled that the management of the company has no hand in the dismissal of the spy police officers since they are employees of the Nigerian Police.
