Procedure For Purchase Of Land
Individuals or corporate bodies wishing to buy land must first of all ensure that the vendor is the real owner of the land or whether he has the authority of the owner to sell.
Such authorities are evidenced by a power of attorney. Where the Vendor is not the owner or has no such power, it is difficult to deal with him.
Another thing a willing buyer must do is to check the land he wants to buy whether there are survey beacons or not.
A buyer must check the integrity of the vendor, this he could do by finding out whom the vendor really is. Some vendors sell the same land to many buyers.
It is important for a willing buyer to use a counsel, so that the counsel will conduct searches for him at the land registry to ensure that the land is not encumbered or part of government land. This is because government will not compensate anybody who willingly built on government land or acquires such property.
Again, a counsel is very important in land purchase because there are clauses in the agreement that will be better interpreted by a lawyer besides drafting the Deed of Conveyance.
