RVHA: Tribunal Dismisses ACN Suit Against Ogu/Bolo Member
The Rivers State House of Assembly Election Tribunal yesterday dismissed the suit brought by the Action Congress of Nigeria (ACN) candidate in the last Rivers State House of Assembly election, for Ogu/Bolo Constituency, Mr Sunday Asetubobe challenging the election of the Peoples Democratic Party candidate (PDP) representing Ogu/Bolo Constituency in the Rivers State House of Assembly, Hon Evans Bapakaye Bipi.
The three-man panel which was presided over by Justice A.N. Umeh at High Court 9, in Port Harcourt, in a unanimous decision dismissed the petition for lack of competence.
Justice Umeh and the other members of his panel agreed after due consideration of the provisions of the electoral law, that the plaintiff/applicant, Mr Asetubobe failed to adhere to the electoral guideline in filling the petition and consequently struck out the case.
Mr Asetubobe had gone to the tribunal, seeking among other things to nullify the election of Hon Evans Bipi on allegations of irregularities and non-compliance with the provisions of the electoral laws.
